Plain-language summary
GigMigo provides scheduling and marketplace tools. It is not an employer, staffing agency, escrow service, or party to gigs arranged by users. Users control what they publish, must verify counterparties, and remain responsible for work, payment, taxes, safety, and legal compliance.
1. Acceptance and eligibility
By creating an account, checking the acceptance box, or using GigMigo after these Terms take effect, you agree to these Terms and acknowledge the Privacy Policy. If you do not agree, do not use the Service.
You must be at least 18 years old and legally able to enter a binding agreement. If you use GigMigo for a business or organization, you represent that you have authority to bind it, and “you” includes that entity.
2. What GigMigo provides
GigMigo provides tools for public and private work calendars, availability sharing, time requests, profiles, direct messages, gig posts, offers, scheduling agreements, referrals, gig credits, and AI-assisted calendar management. Features may be added, changed, limited, or discontinued.
Platform role: GigMigo is a technology platform. Unless expressly stated for a specific service, GigMigo is not an employer, joint employer, staffing or talent agency, payroll provider, insurer, background-check provider, fiduciary, escrow agent, or party to an agreement between users.
3. Accounts and communications
- Provide accurate information, maintain one account per phone number, keep login methods secure, and promptly update information that changes.
- You are responsible for activity under your account and profiles. Notify support@gigmigo.com promptly if you suspect unauthorized access.
- Handles are subject to availability, reserved-word rules, and these Terms. A purchased or parked handle does not grant trademark or other rights in the name.
- We may send transactional SMS messages for authentication and service operation. Message and data rates may apply. SMS login can be avoided only where another supported login method has already been configured.
- Do not transfer or sell an account without written permission.
4. Profiles, calendars, requests, and sharing
You decide what profile and calendar information to publish and what additional information to reveal through roles or share links. You are responsible for checking privacy settings before sharing a link. Recipients can copy or forward accessible information, and revocation cannot erase copies already made.
A time request is a proposal only. It is not booked until the calendar owner approves it. Calendar displays, reminders, time-zone conversions, maps, and availability indicators may contain errors or become outdated; confirm important arrangements directly with the other party.
5. Gig posts, applications, offers, and user agreements
Users who post or respond to work are solely responsible for investigating each other and deciding whether to enter an agreement. A confirmed application or offer records the users’ agreement in GigMigo, but GigMigo does not guarantee identity, qualifications, licensing, availability, conduct, work quality, safety, legality, payment, or completion.
For a scheduled gig, confirmation reserves the agreed time on the Migo or worker profile’s calendar. The hiring business profile’s calendar is not blocked, because a business may engage more than one worker during the same time. Confirmation may make that worker’s other overlapping pending offers unavailable. For an ongoing or open-ended gig, confirmation creates the agreement without adding a calendar booking.
After a user applies, the listing owner may initiate a direct-message conversation before confirmation, and the applicant may reply after that first owner message. Once an application or offer has been confirmed, either side may initiate direct messaging. GigMigo may continue to retain the application, agreement, and related messages as described in the Privacy Policy.
Users are responsible for:
- Accurate gig posts, lawful work, realistic pay and schedules, required licenses, permits, insurance, and workplace safety.
- Determining worker classification, wage-and-hour obligations, taxes, reporting, benefits, immigration or work authorization, and any employment or independent-contractor requirements.
- Negotiating and paying compensation directly unless GigMigo expressly offers a separate payment service for that purpose. A gig-publication fee is not the worker’s wage and is not held for the worker.
- Resolving disputes with counterparties and preserving any records needed for that purpose.
Verification or trust badges indicate only the specific check described. They are not endorsements, guarantees, background checks, or promises of future conduct.
6. Fees, credits, and payments
Current prices and payment methods are displayed before purchase. GigMigo may change prices prospectively. Listing credits have no cash value, are non-transferable unless we say otherwise, and may be subject to promotion-specific limits. We may correct credits granted through error, abuse, or fraud.
Gig-publication fees
A publication fee purchases the publication of one eligible listing; it does not purchase labor, guarantee responses, guarantee a booking, or create escrow. Publication fees are non-refundable after publication except where required by law. If GigMigo verifies payment but fails to publish because of a Service error, contact support for correction, credit, or refund review.
Stablecoin payments
When crypto payment is offered, use only the displayed network, asset, amount, and destination. Blockchain transfers are generally irreversible. You bear network fees, price or depeg risk, wallet security risk, tax consequences, and losses caused by an incorrect network, asset, address, amount, or transaction reference. A listing remains private until GigMigo verifies the transfer.
Card payments
If card checkout is enabled, Stripe processes payment information under its own terms. GigMigo may receive checkout status and transaction identifiers but not the complete card number. Chargebacks or payment reversals may lead to removal of the associated listing or suspension.
You are responsible for applicable taxes, except taxes imposed on GigMigo’s own income.
7. User content
You retain ownership of content you submit. You grant GigMigo a worldwide, non-exclusive, royalty-free license to host, store, reproduce, format, transmit, display, and otherwise process that content only as reasonably necessary to operate, secure, support, and improve the Service and to comply with law. Public content may be displayed to anyone; private content is handled according to the feature and our Privacy Policy.
You represent that you have the rights and permissions needed for your content and that it does not violate law or another person’s privacy, publicity, intellectual-property, contractual, or other rights. We may remove or restrict content that violates these Terms or creates risk.
8. AI Assistant
The AI Assistant can misunderstand instructions, generate inaccurate information, or make unwanted edits. Review prompts, proposed changes, saved results, and change history. You remain responsible for calendar content and decisions made using AI output.
Do not submit highly sensitive information, confidential information you lack authority to disclose, or content prohibited by law or provider terms. AI usage may be limited by daily allowances, safety filters, provider availability, or cost controls. GigMigo may log prompts, outputs, and tool actions for operation, safety, troubleshooting, and audit.
9. Acceptable use
You may not use GigMigo to:
- Violate law; facilitate illegal, unsafe, exploitative, discriminatory, deceptive, or fraudulent work; or evade wage, tax, licensing, or employment obligations.
- Harass, threaten, stalk, impersonate, discriminate against, exploit, or invade the privacy of another person.
- Post false gigs, spam, unauthorized advertising, malware, credential traps, or content you do not have the right to use.
- Scrape, harvest, probe, reverse engineer, overload, disrupt, bypass access controls, or automate access except through an authorized interface.
- Manipulate referrals, credits, payments, reviews, trust signals, identity checks, or platform metrics.
- Use another person’s contact information or calendar without permission, or expose sensitive personal information through public fields.
Automated access, extraction, and competitive reuse
Except where GigMigo gives prior written permission or provides a documented interface that expressly allows the activity, you may not directly or indirectly:
- Use a robot, crawler, scraper, spider, script, browser-automation tool, AI agent, data-mining process, or systematic manual process to access, monitor, search, index, download, extract, copy, or compile the Service or its data.
- Aggregate, mirror, frame, republish, distribute, license, sell, train a model on, or create a directory, dataset, competing service, or substitute product from GigMigo gigs, profiles, calendars, availability, offers, messages, contact information, or other Service content.
- Harvest personal or business contact information for solicitation, marketing, recruiting, profiling, resale, or any purpose not expressly intended by the relevant GigMigo feature.
- Evade rate limits, robots directives, authentication, CAPTCHAs, access controls, technical safeguards, blocks, or a request to stop; use rotating addresses, proxies, multiple accounts, or another person or service to conceal or continue prohibited access.
- Access the Service after GigMigo has suspended or revoked your access or given you written or electronic notice that the access is not authorized.
This section does not prevent a user from exporting their own content where GigMigo provides that feature, sharing an individual public page through ordinary sharing tools, or using a documented interface within its stated limits. Operators of general-purpose public search engines may crawl publicly accessible pages solely to create a public searchable index, only while honoring GigMigo’s robots directives and without creating a cache, archive, commercial dataset, AI-training corpus, or gig-aggregation product. GigMigo may limit or revoke that permission.
10. Third-party services
The Service relies on or links to third parties, which may include communications, AI, email, maps, blockchain, payment, hosting, and content-delivery providers. Their services and terms are outside GigMigo’s control. We are not responsible for a third party’s availability, content, security, or independent conduct.
11. Suspension and termination
You may stop using the Service at any time and may request account deletion through privacy@gigmigo.com. We may suspend, restrict, or terminate access, remove content, or preserve records when reasonably necessary to address a Terms violation, security threat, fraud, legal requirement, nonpayment, or risk to users or the Service.
Termination does not cancel obligations already incurred between users or payment, tax, indemnity, dispute, and other provisions that by their nature should survive.
12. GigMigo property
The Service, software, visual design, trademarks, logos, and non-user content are owned by GigMigo or its licensors and protected by law. These Terms grant only a limited, revocable, non-transferable right to use the Service as intended. No other license is granted.
13. Disclaimers
To the maximum extent permitted by law, the Service is provided “as is” and “as available.” GigMigo disclaims implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and any warranty arising from course of dealing. We do not warrant uninterrupted or error-free operation, permanent storage, accurate AI or map output, successful hiring, payment, work quality, user identity, or user conduct.
Some jurisdictions do not allow certain disclaimers, so portions of this section may not apply to you.
14. Limitation of liability
To the maximum extent permitted by law, GigMigo and its operators, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; lost profits, data, goodwill, or opportunities; personal injury or property loss caused by another user; or losses arising from user agreements, irreversible blockchain transfers, third-party services, or unauthorized access.
To the maximum extent permitted by law, aggregate liability arising from the Service will not exceed the greater of (a) the fees you paid directly to GigMigo during the six months before the event giving rise to the claim or (b) one hundred U.S. dollars. This limitation does not apply where law prohibits it.
15. Indemnity
To the extent permitted by law, you will defend, indemnify, and hold harmless GigMigo and its operators from claims, losses, liabilities, and reasonable expenses arising from your content, your work or user agreements, your violation of law or these Terms, or your infringement of another person’s rights. This obligation does not apply to the extent a claim was caused by GigMigo’s own unlawful conduct.
16. Disputes and governing law
Before filing a claim against GigMigo, email legal@gigmigo.com with a description of the issue and requested resolution and allow 30 days for an informal response. This does not prevent either party from seeking urgent injunctive relief or using an eligible small-claims process.
These Terms are governed by the laws of the State of Georgia, without regard to conflict-of-law rules. Subject to applicable consumer law, exclusive venue for disputes with GigMigo will be the state or federal courts located in Fulton County, Georgia, and each party consents to those courts.
17. Changes and general terms
We may update these Terms prospectively. The updated page will state a new effective date, and we will provide additional notice where required. Continued use after the effective date constitutes acceptance; if you disagree, stop using the Service.
If a provision is unenforceable, it will be modified to the minimum extent necessary and the rest will remain effective. Failure to enforce a provision is not a waiver. You may not assign these Terms without consent; GigMigo may assign them in connection with a business transfer. These Terms and the Privacy Policy are the entire agreement between you and GigMigo regarding the Service unless a separate written agreement applies.
